These FundlyHub Sponsor Terms ("Sponsor Terms") are an agreement between the business that becomes a FundlyHub sponsor ("Sponsor," "you" or "your") and CYTY Inc., doing business as FundlyHub ("FundlyHub," "we," "us" or "our"). They cover the sponsor program: your sponsor page, your perks, the counter, the stickers, the web badge and everything else FundlyHub provides to sponsors (the "Sponsor Program").

The FundlyHub Terms of Service and Privacy Policy also apply to you and to everyone on your team. Where these Sponsor Terms and the Terms of Service disagree about the Sponsor Program, these Sponsor Terms apply.

The person who accepts these Sponsor Terms for a business confirms that they own the business or are allowed by its owner to make it a FundlyHub sponsor, and that they can bind the business to these Sponsor Terms.

A sponsor is a local business that thanks people who hold FundlyHub achievements with perks. Being a sponsor is free: FundlyHub charges no fee for the Sponsor Program.

Sponsors never receive donations through the Sponsor Program, and a sponsor is not the beneficiary of any fundraiser because it is a sponsor. Nothing in the Sponsor Program moves money between you and FundlyHub, or between you and the people who use your perks.

Your page and the stickers say that your business is a FundlyHub sponsor. They do not say that FundlyHub has verified, certified or endorsed your business, its products or its practices, and you must not say so either.

To be a sponsor, a business must:

• Be registered and in good standing in the United States: the 50 states and the District of Columbia.
• Not be in a category that can't join. The list is shown when you become a sponsor, and FundlyHub may update it.
• Pass sanctions screening against the lists of the U.S. Treasury's Office of Foreign Assets Control, together with the person applying and everyone who owns 25% or more of the business.
• Be applied for by a person who shows they can act for it (a code sent to a work email at the business's own domain or to the business phone, or a document a person at FundlyHub reviews), with an owner who completes a photo ID check.

FundlyHub reviews every application and may decline one. We check the business's registration, its category, its website and links, its addresses (a member of your team scans one of the stickers mailed to each location) and whether it is already a sponsor, and we repeat these checks about once a year.

A perk is a thank-you you offer to people who hold a FundlyHub achievement at a tier or higher, from 7 days after they reach that tier. A perk rewards an achievement, never a gift: it can't depend on a donation, its amount or its cause, and it never appears at checkout or on a receipt.

You decide what each perk is, where and when it can be used and how often. FundlyHub reviews perks and may decline or remove a perk that breaks these Sponsor Terms. A perk worth more than $25 a use is reviewed by a person. A sponsor can have up to 10 live perks.

A perk may not:

• be tied to a donation, its amount, or any cause, charity or fundraiser, or say that part of a sale goes to one
• be alcohol, a tobacco or vaping product, or cannabis
• be a raffle, a sweepstakes or another game of chance
• be described as free when it is not
• ask for more personal information, such as joining a mailing list
• exclude people because of a characteristic protected by law

An improvement to a perk takes effect right away. A change that gives people less (a smaller value, a higher tier, fewer places, hours or uses) and the end of a perk take effect 14 days after you make them, and FundlyHub tells the people who follow you or used the perk in the last 90 days. You can pause a perk at any time, for up to 14 days.

You pay for your perks. FundlyHub never pays for a discount or a free item, and you are responsible for any tax that applies to them.

You must honor every perk you offer, at the places and times it lists, to anyone who shows a valid code for it, until the perk ends. Whether perks combine is up to your fine print.

Your team checks codes with the counter at fundlyhub.org/counter (the Sponsor guide shows how). A code is valid once, for 2 minutes after it shows. A use given by mistake can be undone within 15 minutes. If the counter can't reach FundlyHub, perks can't be given until it can.

A person can report a perk that wasn't honored. FundlyHub tells you, and you have 3 days to answer. A report you confirm or don't answer voids that use, and the person gets the use back. A report you dispute is decided by FundlyHub. If your perks are honored less than 90% of the time, we may warn you and then suspend your perks.

FundlyHub shows you counts, times, places, perks and tiers. It does not show you the name, contact details, donations or causes of anyone who uses your perks, and the counter shows nothing personal.

You must not try to identify the people who use your perks from what FundlyHub shows you, make a perk depend on personal information, or use the Sponsor Program to market to them. Someone who chooses to share something with you does so under your own privacy policy.

The members of your team can't use your own perks.

A sponsor has one owner. The owner can invite admins, managers and cashiers and is responsible for what they do in the Sponsor Program. Owners and admins must use 2-step verification. Only the owner can hand the sponsor over to an admin or leave FundlyHub.

Keep your team's accounts and your counter devices secure, and remove the people and devices that should no longer have access. The owner can't delete their FundlyHub account while the sponsor is running: they hand it over or leave FundlyHub first.

You give FundlyHub a license to show your business's name, logo, photos, page and perks on FundlyHub, in its apps and emails and in the promotion of the Sponsor Program, while you are a sponsor and afterwards as a record that you were one.

FundlyHub gives you a limited, revocable license to display the Proud Sponsor stickers, the web badge and the FundlyHub name, as provided, while you are a sponsor. Don't change them, and don't add words such as "verified" or "certified".

Within 14 days after you stop being a sponsor, take the stickers down. The web badge turns into a plain FundlyHub link on its own.

What you publish on your page and in updates must be accurate and lawful, and must not name a charity, a cause or a fundraiser, ask people to give, or promote alcohol, tobacco or vaping products, or cannabis.

FundlyHub may pause your perks, suspend your page or end your participation if you break these Sponsor Terms, if reports show perks are not honored, if a check fails or lapses, or if the law requires it. We tell you why, and you can appeal.

The owner can leave FundlyHub at any time. Your page and perks stay up for 14 days, and then your page becomes a record that you were a FundlyHub sponsor. A business that left can come back within 12 months with a new review.

You are responsible for your perks, your products and services, your team, and for following the laws that apply to your business, including consumer protection, advertising, tax and privacy laws.

You will defend and indemnify CYTY Inc. against claims that arise from your perks, your products or services, or your breach of these Sponsor Terms.

The Sponsor Program is provided as is. The disclaimers and limitations of liability in the Terms of Service apply to it.

FundlyHub may update these Sponsor Terms. Each version has its own version string, and FundlyHub records which version your business accepted and when. We tell the owner about a material change before it takes effect. If the owner does not accept it, they can leave FundlyHub.
